Liability Waiver & Assumption of Risk Agreement

I affirm that I understand the activities in which I and/or my child may engage at Cedarwood Outdoor School, LLC (“Cedarwood”) including but not limited to hiking, trail exploration, nature-based instruction, outdoor games, field activities, use of natural terrain, and related outdoor educational programs, may be physically strenuous and involve inherent dangers.

I understand these activities may expose participants to risks including, but not limited to, slips, trips, and falls on uneven terrain, exposure to weather conditions, contact with plants or wildlife, insect bites or stings, collisions with other participants or natural objects, use of knives, strains, sprains, and other injuries, including serious injury or death.

I voluntarily and knowingly assume ALL risks, both known and unknown, associated with participation in Cedarwood’s outdoor school activities. In the event that any term of this Waiver shall be invalid, illegal, or unenforceable, the validity of the other terms of this Waiver shall not in any way be affected thereby and shall remain in full force and effect to the maximum extent permitted by law.

Participant Release of Liability

I hereby irrevocably, unconditionally, and forever waive, release, and discharge Cedarwood and its owners, employees, instructors, independent contractors, volunteers, agents, and landowners and property operators where Cedarwood activities take place (collectively, the “Released Parties”) from any and all claims, demands, actions, and causes of action, known and unknown, current or hereafter accrued, foreseen and unforeseen, latent or patent, of any kind or nature including but not limited to personal injury, illness, death, or property damage arising out of or related to my or my child’s participation in Cedarwood’s activities.

If the participant is a minor, I am the parent or legal guardian. I waive, release, and agree not to bring any claim of my own against Cedarwood or the Released Parties arising out of or related to injury, illness, or death of my child during Cedarwood’s activities, including but not limited to claims for loss of consortium, loss of companionship, emotional distress, and/or recovery of medical expenses incurred by me.

Equipment Use and Product Liability Acknowledgment

Cedarwood may provide or make available equipment used in connection with its activities, including but not limited to outdoor gear, tools, knives, safety equipment, and instructional materials (“Equipment”). I understand the risks associated with use of the Equipment and hereby waive and release all claims against Cedarwood and the Released Parties known and unknown, current or hereafter accrued, which in any way arise out of or relate to the condition, design, manufacture, warning, or use of any Equipment, except to the extent such waiver is prohibited by law.

Cedarwood shall not be responsible for injuries, damages, or losses arising from (i) misuse of Equipment, (ii) failure to follow instructions or warnings, (iii) unauthorized modification or alteration of Equipment, (iv) use of Equipment outside its intended purpose, or (v) use of equipment supplied by me, my child, or any third party.

I agree, to the fullest extent permitted by law, to defend, indemnify, and hold harmless Cedarwood and its owners, officers, employees, instructors, volunteers, agents, and any property owners where activities occur (collectively, the “Released Parties”) from and against any claims, demands, actions, damages, losses, liabilities, or expenses, including reasonable attorney’s fees, arising out of or related to: (i) my misuse of any Equipment, including use contrary to instructions or safety practices; (ii) my child’s misuse of Equipment; (iii) my failure to reasonably supervise my child; and/or (iv) any equipment or gear supplied by me, my child, or a third party, except that no Released Parties shall be entitled to be indemnified in respect of any loss, damage, or claim incurred by such Released Parties by reason of gross negligence, bad faith, or willful misconduct with respect to such act or omissions. This obligation does not apply to claims arising solely from an alleged defect in Equipment provided by Cedarwood, to the extent such claims are governed by applicable product liability law.

I agree to comply with the rules and regulations of Cedarwood and with instructions and directions of staff members during activities or events. I and my child are fully informed of the nature of the risks inherent in the activities in which I or my child will participate and have read the foregoing before signing below.

Emergency Medical Authorization

I hereby authorize Cedarwood, its staff, and its agents to obtain or arrange emergency medical care for myself or my child if an emergency (as determined by Cedarwood) occurs during, arising from, or in connection with my or my child’s participation in Cedarwood’s activities. I authorize Cedarwood to disclose to emergency responders and medical providers such information as Cedarwood reasonably believes necessary to obtain or facilitate emergency medical care for myself or my child, including known allergies, medications, relevant medical history, and emergency contact information. I acknowledge and agree that I am solely responsible for all costs of such emergency medical care. Cedarwood is not responsible for any costs and does not guarantee that any provider or facility will be in-network for any insurance plan. Cedarwood does not provide health insurance for me or my child and makes no representation regarding coverage, benefits, or reimbursement for emergency medical care. Cedarwood is not a medical provider and does not assume any duty to diagnose or treat medical conditions. Decisions by Cedarwood to seek emergency medical care will be made in good faith and based on the information reasonably available at the time.

MEDIA RELEASE AND CONSENT TO USE NAME, IMAGE, AND LIKENESS

I grant Cedarwood permission to photograph, record, or otherwise capture my or my child’s image, likeness, voice, or appearance in connection with Cedarwood’s activities (“Media”).

If I am an adult participant, I consent to Cedarwood’s use of my name, image, likeness, and appearance as captured in such Media for lawful promotional, educational, and informational purposes, including web-based publications, social media, and printed materials, without payment or other consideration.

If the participant is a minor, I represent that I am the parent or legal guardian of the minor participant and have full legal authority under Idaho law to make decisions on the minor’s behalf, including granting consent for the use of the minor’s name, image, likeness, voice, and appearance. I give this consent knowingly and voluntarily. To the fullest extent permitted by applicable law, I consent to Cedarwood’s use of the minor’s name, image, likeness, voice, and appearance as captured in Media for lawful promotional, educational, and informational purposes, provided such use does not falsely imply endorsement and does not violate applicable rights of privacy or publicity.

I understand that all Media may become the property of Cedarwood and that I will not receive compensation for its use. I waive any right to inspect or approve the finished Media in which my likeness, or my child’s likeness, appears, and I waive any claim to royalties or other compensation arising from such use.

I understand that consent for a minor may be withdrawn. Accordingly, Cedarwood’s use of Media involving a minor is authorized unless and until Cedarwood receives written notice revoking consent. Upon reasonable written notice, Cedarwood will make commercially reasonable efforts to cease future use of such Media, but this will not require the removal or recall of materials already produced, published, or distributed prior to notice.

Nothing in this section releases or limits any rights that cannot be waived under applicable law, nor authorizes use of Media in a defamatory, misleading, or unlawful manner. I have read and understand the foregoing release of liability and media release. I understand that by signing this form I am waiving valuable legal rights.
